The Court of Appeal has ordered a retrial for a Roscommon man who was acquitted of his mother's murder by reason of insanity.
29-year-old Paul Henry of Abbeystown pleaded not guilty at his original trial but wants to change his plea to manslaughter.
Paul Henry pleaded not guilty to murdering his mother Ann Henry in 2011 when tried at the Central Criminal Court last year.
He was acquitted by reason of insanity and was sent to the Central Mental Hospital.
However the 29 year old appealed the acquittal and asked to be retried to allow him plead guilty to manslaughter by reason of diminished responsibility.
A manslaughter conviction means he would serve a determinative sentence rather than being held indefinitely in Dundrum.
He's won his appeal – the court found there was an 'element of misdirection' to the jury by the trial judge and ordered a retrial.
