The jury will soon begin its deliberations in the trial of a former soldier accused of murdering a man outside a chipper on North Strand Road in Dublin.
Donal Colgan of Killarney Court, Killarney Street in Dublin 1 claims he was provoked into stabbing David Sheridan in August 2014.
On August 17th 2014, Donal Colgan said he drank 12 pints of cider in his local pub and went for a bag of chips on his way home.
David Sheridan also went into the same chipper that night with his friend Gary Kinlan.
In his evidence, Mr Colgan said he didn’t know them and chose to ignore some sort of remark they made about him.
Outside, he claims Mr Kinlan squared up to him and hit him in the face before Mr. Sheridan came out and kicked him a few times.
He said he collapsed after being hit in the head with a bag of cans.
Afterwards, the trial heard he walked to his apartment, got a large knife and returned to the chipper where he stabbed Mr. Sheridan to death.
He claims he totally lost control after being provoked, but it will be up to jury to decide whether there was an intention to kill or cause serious harm after his plea to the lesser charge of manslaughter wasn’t accepted by the DPP.
