The Supreme Court has begun hearing yet another appeal by Graham Dwyer as he continues to fight his conviction for the murder of Elaine O’Hara.

The Cork-born architect failed to convince the Court of Appeal to overturn his conviction in March last year. 

He claimed the retention of mobile phone data in the case was unlawful and that the fruits of that evidence should therefore not have been admissible at his trial in 2015.

Dwyer also raised issues with the decision to allow sex tapes to be shown at the trial, media coverage and the judge for an apparent look he gave him at one point.

All those arguments were dismissed by the Court of Appeal but the Supreme Court has agreed to hear a further challenge.

His lawyers have also criticised the Court of Appeal for the lack of weight it attributed to the evidence in its judgement last March.

One of the central issues at dispute is whether the prosecution can use material that should never have been allowed in the first place.

Death of Elaine O’Hara 

Thirty-six-year-old Elaine O’Hara was last seen in August 2012 in a park in Shanganagh, south Dublin. 

Her remains were found the following year on Killakee Mountain and identified from dental records.

Dwyer was unanimously convicted by a jury in March 2015 and sentenced to life in prison.
