It is reported today that Alan Shatter is to appeal a ruling that he broke the law in comments he made about another TD.
According to the Irish Independent, the case of the former Justice Minister is due for mention at the Circuit Court tomorrow.
It is understood that the government will have no involvement in the appeal.
The Data Protection Commissioner found Mr. Shatter broke the law when he disclosed personal information about Deputy Mick Wallace during an edition of 'PrimeTime' on RTÉ television in May of last year.
Mr. Shatter disclosed that Mr. Wallace did not receive penalty points when he was stopped by gardai for using a mobile phone while driving in Dublin in 2012.
Alan Shatter said at the time that he received the information at a garda briefing, during which the incident involving the Independent TD was used as an example.
The Dublin-South TD later apologised in the Dail.
The Commissioner found that the then-Minister Shatter as a 'data controller' in relation to personal data about Deputy Wallace and he failed to uphold his statutory duties in that role.
