Console’s legal team has been given time to consider sworn statements made by the charity’s founder Paul Kelly, his wife Patricia and son Tim.

The three affidavits were handed over to the charity yesterday afternoon on behalf of the Kellys. They were filed in response to orders freezing their assets last week. 

The documents were not opened in the High Court today but it is understood they contain statements of means, as per a court order made last week.

No member of the family was in court today when the charity was given until this day next week to consider the affidavits.

The sides are also trying to agree living expenses for the Kellys, and they were given liberty to come back to court if an agreement cannot be reached.

Freezing orders over their assets will also remain in place for the time being.

The case of Paul Kelly’s sister Joan McKenna is also due to return to court next week, after Mr Justice Gilligan gave Console time to make inquiries into her claim that she was never a director of the charity – despite documents carrying her name being submitted to the Companies Registration Office.
