The Regency Hotel murder trial will continue after the Special Criminal Court allowed certain evidence to be admitted.
The defence and prosecution have been arguing about the Garda identification of a photo at the centre of the case.
Father-of-two David Byrne was shot dead at the Regency Hotel almost two years ago.
Three weeks ago 25-year-old Patrick Hutch of Champions Avenue in Dublin went on trial for his murder – which he denies.
A photo was taken at the scene of the shooting which showed a man dressed as a woman holding a gun outside the hotel.
The prosecution say Patrick Hutch is the man in that photo - and two gardai identified him as such.
But the defence barrister described this identification process as ‘sullied and tainted’ and a ‘dog’s dinner'.
Following extensive legal argument, the Special Criminal Court has decided it is allowing the identification process of the photo to be admitted into evidence.
Judge Tony Hunt said there wasn’t some conspiracy or cover-up involved in the identification process and he ruled it had not been contaminated.
The trial will now continue and is set to resume on Monday afternoon.
