New Democracy MP, Theodoros Fortsakis has submitted a legal challenge to today’s referendum in Greece, the Professor of the University of Athens has told Newstalk radio.
“I just opposed the procedure and have asked the competent committee supervising today’s procedure to consider that it is void and null because the text of the so-called agreement in not communicated to electors.”
“Nobody knows what it’s about.”
Mr Fortsakis says he has submitted a challenge to the commission overseeing the vote in his constituency in Skoufa Street, at the voting centre in Dionysios Church in Athens.
“It [the referendum] has not been communicated to voters; it was explained in a particular way which is not accepted by the European Institutions.
"The courts in Greece did not review the constitutional legality of the referendum – we have no legal procedure in order to review the legality of the referendum yet”, he insisted.
“Last Friday there was no decision about constitutionality – we have no ruling on that,” he said in relation to the Greek administrative court's decision to overrule an appeal from two Greek citizens that the referendum was illegal.
According to Fortsakis there are three specific elements making the poll unconstitutional: Firstly there was “not enough time given to electors to consider the question, second, the question is not clear – we’re not sure if the question is a real question”.
“Third, according to the Greek constitution, no financial questions can be submitted to referendum and it is clear that this is a question directly linked to financial matters.”
He added that he has “submitted a legal challenge to the referendum and this challenge will follow the legal way which many weeks after the referendum will lead to a judgement before the Supreme Court under article 100 of the constitution. It will be the Supreme Court that will decide".
