A festival goer who broke his ankle after he was knocked to the ground at Oxegen has lost an action for damages against promoters MCD.

Software engineer Mark Ponisi of Roselawn, Tipper Road in Naas, Co Kildare blamed his injury on the muddy ground conditions at Punchestown in 2007.

Mark Ponisi was standing far away from the main stage watching Kings of Leon when he was knocked to the ground and trampled on.

He broke his ankle and sued MCD for damages claiming that his left boot got stuck in the mud during a crowd surge because the ground surface was unsafe.

However, Ms Justice Mary Irvine has found his injuries were caused by the 'recklessly robust behaviour of some concert goers' and not due to any negligence on behalf of the promoters.

The judge noted that prior to the accident Mark Ponisi and his friend had been able to carry their pints around the arena without spilling them.

She also said that cases like this put at risk the holding of large outdoor events which give so much pleasure to so many people.
