A garda and property investor has told Thomas Byrne’s fraud trial that the former solicitor failed to pass on a cheque to discharge a mortgage loan of nearly €1.9 million.
Brian Whelan was one of three investors who bought a block of flats on Dorset Street in Dublin in 2006 with a mortgage from Permanent TSB.
He’s given evidence that they re-mortgaged the investment property a year later, on an undertaking from their solicitor Thomas Byrne that the new loan would go towards discharging the old loan.
Dublin Circuit Criminal Court has heard the original loan facility was never repaid.
Mr Whelan will be cross-examined tomorrow.
