The Court of Criminal Appeal is to consider whether a Co. Clare man serving life for the murder of his neighbour can appeal his conviction to the Supreme Court.
Brendan O’Sullivan shot Leslie Kenny in the garden of his home at O’Gorman Street, Kilrush on July 29th, 2009. He was convicted of murder at the Central Criminal Court in 2010.
He subsequently lost an appeal centred on whether the judge had adequately explained to the jury the verdicts of manslaughter and self defence.
His lawyers now want permission to refer the case to the Supreme Court on the basis that it raises a point of law of exceptional public importance.
The Court of Criminal Appeal will decide at a later date whether to allow a further challenge.
