IBRC seeks damages against Peter-Darragh Quinn

It is expected IBRC will be seeking multi-million euro damages against Peter-Darragh Quinn for hiding assets from the bank.

Judgment has been entered against the businessman who has so far evaded a 3 months jail sentence imposed last July for contempt of court orders.

The orders were put in place in 2011 and were designed to stop the dispersal of nearly €500 million worth of assets in the Quinn International Property Group.

The nephew of the bankrupt businessman did not turn up for sentencing after the finding of contempt was made against him and he can not be arrested outside of the Republic on a civil matter.

Decision on damages to be made in April

Judgment was entered today by Mr. Justice Peter Kelly who was satisfied Peter-Darragh Quinn had not entered a defence to the claim by IBRC (in special liquidation).

Damages will be assessed at a hearing on April 18th.

In relation to the broader legal action by IBRC against the Quinns, Mr. Justice Kelly refused to grant an order for discovery to the bank.

'The Quinns have a number of battlefronts they're fighting on at present' he said, in reference to the IBRC Act 2013 which imposes a stay on all proceedings against the bank and to an upcoming application by the Quinns to have the case against them struck out'.

The judge said he was conscious the Quinns have limited resources available to them and he was of the view that an order for discovery at present would 'simply swamp them'.
