DPP to appeal 'lenient' sentence for rapist Patrick O'Brien

The Director of Public Prosecutions (DPP) has lodged appeal papers in the case of convicted rapist Patrick O'Brien saying the sentence was unduly lenient.

Mr. O'Brien from Bray in Co. Wicklow was sentenced to 12 years in jail with 9 suspended after pleading guilty to raping and indecently assaulting his daughter Fiona Doyle over a 10 year period.

He pleaded guilty to raping and indecently his daughter from 1973 to 1982 at Mackintosh Park, Pottery Road in Dun Laoghaire.

Ms. Doyle has welcomed the decision by the DPP.

'Inappropriate' initial sentence

The 72-year-old was initially given a 12-year sentence with 9-years suspended in January.

However Mr. Justice Paul Carney admitted subsequently that it was "inappropriate" to release him and he began serving a 3-year sentence.

The Judge accepted that releasing him initally was inappropriate and insensitive.

The judge also said he had no hesitation expressing his ''profound regret'' to the victim Fiona Doyle.

Ms. Doyle spoke outside the court when her father was jailed for 3 years.
