A Wicklow based detective has initiated a legal action in the High Court against the Garda Commissioner Nóirín O’Sullivan.
Detective Garda Catherine McGowan claims she did not have the power to establish an internal board of inquiry into alleged breaches of discipline.
Two years ago, a jury cleared Detective McGowan of forging a letter from the Director of Public Prosecutions.
She wants the inquiry stopped because she believes the acquittal rules it out under Garda regulations as set out in law.
The court has some legal issues to deal with this afternoon and it is hoped her judicial review will get underway later this week.
