A Wexford businessman denies kicking in the doors of a hotel and smashing a window to stop a receiver taking possession of the property.
The High Court has made a temporary order stopping Robert Roche - a director of the Saltees Hotel in Kilmore Quay - from trespassing on the premises.
The court heard there are photos to back up receiver Kieran Wallace's claims that businessman Mr. Roche smashed a window, kicked in doors and climbed up on the roof of the Saltees Hotel when security staff moved in to take possession of the property yesterday.
The account by the hotel director to the court was somewhat different. He said he walked into the building with garda assistance and that the window was damaged when he was pushed into it during a scuffle.
He claims he is a victim of fraud and disputes the entitlement of the receiver to take control of the hotel over an unpaid €1.7 million Investec loan.
However Mr. Justice Bernard Barton has put in place a temporary order allowing the receiver to secure the premises over concerns about criminal damage, and that fixtures might be removed from the now-defunct hotel.
