The Court of Appeal has been asked to step in and restore the good reputation of a former Anglo Irish Bank executive.

Bernard Daly, who used to work as Anglo’s Company Secretary, is trying to have his conviction for conspiring to defraud Revenue set aside.

Sean Guerin, Senior Counsel for Bernard Daly, said his client was denied a fair trial and deserved a fair crack of the whip.

At the end of July, the 67-year-old was found guilty of furnishing false information to the Revenue Commissioners, conspiring to delete accounts from Anglo’s system and conspiring to defraud Revenue.

One of the accounts was in the name of a man with links to a senior figure at the bank, and Mr Daly was jailed for two years.

During his appeal today, it was argued that the concept of corroboration wasn’t explained to the jurors properly and that his 35-day trial was unfair from beginning to end.

His co-accused Tiarnan O’Mahoney, who used to be second in command at Anglo, is also appealing his conviction and three-year sentence. He claims he should have been tried separately, and believes the decision not to was unfair and proved to be extremely damaging.
