The High Court has awarded a settlement of €2 million in the case of a young boy who suffered brain devastating brain injuries at birth. University Hospital Waterford has also apologised to the 4 year old boy.
Dylan Kenny of Greenfield, Old Tramore Road, Waterford is to receive 2 million euro in a High Court settlement with the HSE.
The court heard Dylan's claim arose out of the mismanagement of his mother's labour and his birth at University Hospital Waterford in January 2010.
His laywers say foetal distress prior to his delivery went unrecognised on his CTG trace and obstetric assistance was not requested.
They say obstetric intervention and an early instrumental birth would have spared Dylan an irreversible injury caused from a lack of blood and oxygen to the brain.
The hospital has apologised to the family and admitted Dylan's injuries should not have happened.
Today's €2 million settlement, approved by Mr Justice Kevin Cross, will be reviewed in 3 years time.
