A girl has lost her High Court action against her former school over injuries she sustained during hockey training.

Ailbhe Cole slipped on wet grass in the Sisters of St Josepg of Cluny secondary school, Killiney, Dublin, with Mr Justice Raymond Fullam saying it was "an accident pure and simple".

"Strange as it may seem, accidents can happen where 'somebody else' is not to blame. This was such an occasion," he concluded.

Ms Cole, who is now attending University College Dublin, was completing her Leaving Cert on November 19th 2012 and was training and playing hockey on the school pitch of a winter's evening when the accident occurred.

Ms Cole claimed the pitch was insufficiently lit, and further claimed the kerb area of the pitch was slippery, resulting in her fall.

The school denied the claims, contending that sports training only took place "light permitting". The court heard the school has since got a new pitch and facilities.

Mr Justice Fullam reiterated that Ms Cole's injury was not as a result of negligence from the school, before dismissing the case.

The counsel for Ms Cole asked that costs of the two days action not be awards against the student. Mr Justice Fullam said costs follow the event but he was sure the sides could come to an agreement.
