Starbucks faces a lawsuit in Northern California over claims that they deliberately fail to fill some of their beverages fully. 

The coffee chain faces a case from two plaintiffs that their latte drinks are not the sizes that they state on their menu, with the claim stating that "tall Lattes are not 12 fluid ounces, Grande Lattes are not 16 fluid ounces, and Venti Lattes are not 20 fluid ounces". 

The case states that Starbucks are "cheating the consumer" as the drinks are "uniformly underfilled pursuant to a standardized recipe", by as much as 25%. 

The claim adds that the recipe which underfills drinks was put in place in 2009 by the company in an effort to save money on the cost of milk, one of their most expensive ingredients. 

Should the class action lawsuit be successful, it would be open to "all U.S. Class Members who purchased a Starbucks Latte". 

Speaking to Eater, a Starbucks spokesperson said "we are aware of the plaintiffs' claims, which we fully believe to be without merit. We are proud to serve our customers high-quality, handcrafted and customized beverages, and we inform customers of the likelihood of variations".
