Joe O'Reilly is going to apply to the Supreme Court to hear an appeal against his conviction for murdering his wife Rachel at their Dublin home in 2004.

Last year, the Court of Appeal dismissed his attempt to have it declared a miscarriage of justice.

On October 4th 2004, Rose Callaly found her daughter Rachel's badly beaten body in the bedroom of her home in Naul, north Dublin - a home she shared with her husband Joe O'Reilly and their two children.

O'Reilly was found guilty of her murder in 2007, and made two unsuccessful appeals to have his conviction overturned.

Last year, he argued his conviction should be declared a miscarriage of justice because a portion of his book of evidence was left in the jury room during his trial.

The Court of Appeal dismissed it because he had been made aware of the situation on Day four of the trial, and the jurors had denied reading it.

His lawyers are now planning to seek permission from the Supreme Court to listen to their appeal over that decision.

They are also looking for legal aid to pursue that application. His case will be mentioned again in July.
