Graham Dwyer was found guilty on Friday of the murder of childcare worker Elaine O’Hara.

If Gardaí had not recovered two unregistered pre-pay phones at the bottom of a reservoir, Graham Dwyer might not have been convicted.

So how much of our phone or computer data can be traced?

Associate professor with the School of Law in Trinity College Dublin, Eoin O’Dell, spoke to Lunchtime today and detailed what can be traced through your technology.

How much information is available electronically?

Eoin O'Dell answered: "The answer is, all of it.

"Our entire lives are now built around electronic devices whether they are our laptop or desktop computers or our mobile phones.

"Once you have technology, you then have the ability of the technology to record and then beyond that, you have the ability of the technology to transmit.

"A recent survey found that 45% of mobile phones are looking and recording our location and on average, that location information is transmitted to a further 80 companies."

If you delete the information, is it permanently deleted?

"No matter how well we as ordinary consumers attempt to delete information from our consumers devices, people with considerably more sophisticated electronic resources will be able to break the data out of those devices.

"The second thing is the extent to which this information is available to be used against you as a witness.

"All of this traffic data was recorded by the various internet and telecom service providers and accessed by the police.

"In a case last year taken by Judicial Rights Ireland, that directive was struck down on the grounds that everyone has the right to privacy and we can't all be presumed to be doing the wrong thing and the question was whether the legislation... was also invalid."
