An inmate of Mountjoy Prison in Dublin wants a caution he received to be set aside because he believes the disciplinary process was flawed.

The prisoner claims he was denied a proper hearing after he was accused of intimidating and verbally abusing a senior prison officer.

The prisoner, who cannot be named at this stage, appeared before a disciplinary hearing after the prison officer made a complaint against him.

She claimed that he tried to intimidate her while he was in the prison’s visitor area.

She said he made inappropriate remarks and referred to her as a “dog”.

The prisoner denied the allegations during a two-day disciplinary hearing before the Governor.

He claims he was refused the opportunity to call certain witnesses and view CCTV footage that he felt would be supportive of his version of events.

Ultimately, he was issued with a caution, and he is worried that will reflect badly on him when he comes before the parole board.

He wants the High Court to set aside the caution because he believes the disciplinary process was flawed and breached his constitutional rights.

An application for a judicial review was made today but the judge has put the matter back until next month to allow the Governor a chance to respond.
