Singer Tommy Fleming has won his legal action against Irish TV for the unlawful broadcast of one of his DVDs.

In its judgement, the High Court agreed his career was damaged by the breach of his intellectual property rights.

In 2004, Tommy Fleming recorded ‘Voice of Hope' in The Basilica at Knock.

Ten years later, Irish TV broadcast a promotional DVD sent out by the singer as is standard practice in the entertainment industry.

The station believed it had permission to do so, and did so under the title ‘the Tommy Fleming Extravaganza’.

Mr Fleming only became aware of the unauthorised scheduling under what he described as an “unofficial title” when it was broadcast for a second time.

The singer claimed their actions resulted in a drop in sales and damaged his career.

By way of example, he said he has only made one appearance on The Late Late Show since.

Beforehand, he said he’d make an average of two every year.

In awarding €150,000 in damages against the now defunct station, Mr Justice Paul Gilligan accepted Mr Fleming’s career had been undermined by the unlawful broadcasts and said the public perception of him had been altered.
