The High Court has lifted the freezing order on a current account used by the former CEO of Console, Paul Kelly, and his wife Patricia.

Mr and Mrs Kelly had been seeking access to the account in order to pay their living expenses.

They were looking to unfreeze two accounts: one was an current account that was overdrawn by more than €100, while the second was a savings account with €6,700 in it.

The judge amended the barring order, allowing the Kelly's access to the overdrawn current account so they can cash social welfare cheques and pay living expenses.

However he refused to lift the freeze on the savings account, after representation for the provisional liquidator of Console argued that the money likely belonged to the charity.

The case had been put back from this morning as Mr Justice Paul Gilligan sought to find out if the Kellys had been co-operating with the liquidator, Tom Murray.

Mr Murray wrote to them last Thursday seeking a meeting and asking them to fill out a questionnaire - but has yet to receive any reply.

The case is due before the High Court again next Thursday.

Mr Justice Gilligan said if the Kellys want access to the almost €7,000 in their savings account, they will have to prove the money does not belong to Console.
